These Terms of Service ("Terms") govern your access to and use of redpleasures.ca (the "Site"), including browsing, purchasing products, and any services provided by Chhokra Inc ("we," "us," or "our"). By accessing the Site, placing an order, or checking the box "I agree to the Terms of Service" at checkout, you confirm you have read, understood, and agree to be bound by these Terms on behalf of yourself or the entity you represent. If you do not agree, do not use the Site.

We may update these Terms at any time. Continued use after changes constitutes acceptance. We will notify you of material changes via email or a prominent notice on the Site.

1. Eligibility

  • You must be at least 18 years old (or the age of majority in your jurisdiction) and legally capable of entering contracts to use the Site or purchase products.

  • By using the Site or ordering, you represent and warrant that you meet these requirements and that all information you provide is accurate.

  • We reserve the right to refuse service, terminate accounts, or cancel orders if we suspect you are under 18, providing false information, or violating these Terms.

2. Products and Orders

  • Descriptions and Availability: Product descriptions, images, and specifications are for informational purposes only and provided "as is." We strive for accuracy but do not guarantee completeness or error-free content. Products may vary slightly from descriptions. Availability is not guaranteed.

  • Pricing: All prices are in Canadian Dollars (CAD), exclusive of applicable taxes, duties, and shipping fees (displayed at checkout). We reserve the right to correct pricing errors.

  • Order Process: Placing an order is an offer to purchase. We may accept, reject, or cancel it at our sole discretion (e.g., due to stock issues, pricing errors, fraud suspicion, or legal restrictions). You will receive email confirmation upon acceptance.

  • Order Modifications/Cancellations: No changes or cancellations after confirmation unless we agree in writing.

3. Payments

  • Payments are processed securely via third-party providers (e.g., Shopify Payments or Stripe). You authorize us and our processors to charge your payment method.

  • All charges are non-refundable except as stated in our Returns Policy. You are responsible for chargeback fees, disputes, or failed payments.

  • We do not store full payment details; see our Privacy Policy for handling.

4. Shipping and Delivery

  • Shipping times are estimates only. We are not liable for delays due to carriers, customs, weather, or force majeure events.

  • Title and risk of loss pass to you upon shipment. Inspect packages on delivery and report issues immediately.

  • All shipments are discreetly packaged with neutral labeling (e.g., "Chhokra Inc") to protect your privacy.

  • International orders may incur duties/taxes; you are responsible for these.

5. Returns, Refunds, and Warranties

Our Returns and Refund Policy, available at redpleasures.ca/pages/returns-policy (incorporated herein by reference), governs all returns, exchanges, refunds, and satisfaction guarantees. All sales are final except as explicitly stated therein. Products are sold "as is" without warranties beyond those provided by manufacturers. We disclaim all implied warranties to the fullest extent permitted by law.

6. User Conduct and Prohibited Activities

You agree not to:

  • Use the Site for illegal purposes or violate any laws.

  • Submit false information, impersonate others, or engage in fraudulent activity.

  • Reverse engineer, scrape, or interfere with the Site.

  • Post harmful content, harass others, or transmit viruses.

  • Resell products without permission or use them in violation of health/safety laws.
    We may monitor use and cooperate with authorities.

7. Intellectual Property

  • All Site content (text, images, logos, trademarks) is owned by us or licensors and protected by copyright/trademark laws. You may not copy, modify, distribute, or commercially exploit it without written permission.

  • Product images are for personal reference; limited license for your purchases.

8. Disclaimers and Limitation of Liability

  • AS IS BASIS: The Site and products are provided "as is" without warranties of any kind, express or implied, including merchantability, fitness for purpose, or non-infringement.

  • No Liability: To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, or punitive damages (e.g., lost profits, data loss, injury from product misuse), even if advised of the possibility.

  • Liability Cap: Our total liability shall not exceed the amount you paid for the product/order in question.

  • Products are for adult use only. Follow all instructions and warnings. We are not responsible for misuse, allergies, or improper handling.

9. Indemnification

You agree to indemnify, defend, and hold harmless Chhokra Inc, its officers, directors, employees, and affiliates from any claims, losses, liabilities, damages, costs, or expenses (including reasonable attorney fees) arising from your breach of these Terms, misuse of products, or violation of laws.

10. Termination

We may suspend or terminate your access/account at our discretion for any reason, including violations, without notice or liability.

11. Force Majeure

We are not liable for delays/failures due to events beyond our reasonable control (e.g., acts of God, strikes, pandemics, supply chain issues).

12. Governing Law and Disputes

  • These Terms are governed by the laws of Ontario and Canada, without regard to conflict of laws principles.

  • Any disputes shall be resolved exclusively in the courts of Ottawa, Ontario. You consent to personal jurisdiction there.

  • You waive rights to class actions or jury trials to the extent permitted by law.

13. Miscellaneous

  • Entire Agreement: These Terms, plus Privacy Policy and Returns Policy, constitute the full agreement.

  • Severability: Invalid provisions do not affect the rest.

  • No Waiver: Our failure to enforce any right does not waive it.

  • Assignment: We may assign these Terms; you may not without consent.

  • Third-Party Links/Services: We are not responsible for linked sites or processors.
